Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Blue Delta mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users, including agency administrators and field personnel.

2. Authorized Use

Blue Delta is a professional tool licensed to law enforcement agencies, fire departments, and other authorized organizations for the purpose of tracking crisis deflection and diversion program activities. Access is granted on a per-agency basis. You may only use the App if you have been authorized by your agency administrator and have a valid account.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You must not share your login with others or allow unauthorized access to your account. You must notify your administrator immediately if you suspect your account has been compromised. SPROKIT, Inc. is not liable for any loss or damage arising from unauthorized use of your account.

4. Acceptable Use

You agree to:

• Use the App only for its intended purpose of deflection and diversion program tracking
• Enter accurate and truthful information in all reports
• Comply with all applicable laws, regulations, and your agency's policies
• Respect the privacy and dignity of program participants

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to other users' data
• Reverse engineer, decompile, or tamper with the App
• Upload malicious code or interfere with the App's operation
• Use the App to store or transmit information that violates applicable law

5. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

6. Intellectual Property

The App and all content, features, and functionality are owned by SPROKIT, Inc. and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your agency's authorized purposes.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. SPROKIT, Inc. does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the App is at your sole risk.

8. Limitation of Liability

To the fullest extent permitted by law, SPROKIT, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages.

9. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or an in-app notification. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

10. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or at the request of your agency administrator. Upon termination, your right to use the App ceases immediately.

11. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
